4 THING TO CONSIDER BEFORE ISSUING A LAWSUIT
There are times when litigation is appropriate and times when it is not. We invite to analyze the situation with these reminders:
Cost/Benefit.
First and foremost, you must do a cost/benefit analysis of the potential lawsuit. If the reward outweighs the risk, then litigation may be the right approach.
Chance of winning.
Take an objective look at the details surrounding your case and ask yourself, “Can I really win?” You may be 100% confident that you have been wronged and you deserve compensation, but if you don’t have the evidence or there is some other reason that you stand to lose the case, then it is probably not worth it for you to pursue legal action.
Alternatives.
Make sure you consider all possible alternatives to litigation. Don’t assume that some other method of recovery won’t work. Some other settlement or alternative form of dispute resolution like mediation may be a better route depending on the circumstances of the case.
Time.
How much time are you truly willing to spend mired in litigation? It is no secret that litigation can be a long and drawn out process.
HOW TO REDUCE LEGAL DESPUTES: CONTRACT CERTIFICATION
Certification of employment contracts is an Italian legal procedure whose main function is to reduce legal disputes about the classification of employment contracts.
In Italy, the classification of employment contracts is very important as different contracts provide different rights and levels of protection.
All contracts are concerned, but quasi-subordinate/self-employment contracts and sub/contracts for outsourcing services are specifically targeted.
The activation process involves a significant amount of back office work. Infact, upon receipt of the certification request and all the necessary documents the competent commission undertakes a review of the documentation (and investigate if necessary) and finally decides whether to award the certification or not. The procedure should take no longer than 30 days but this may be extended if the commission needs to carry out further investigations.
The bodies that can provide certification services are appointed by law and may be set up by:
• The Professional Association of Labour Advisors (and we are Labour Advisor)
• Universities and University Foundations (and we a have an agreement with “Marco Biagi Foundation”)
• Bilateral bodies (set up by unions and employers’ associations)
• Territorial Labour Inspectorates
• Ministry of Labour
• Provinces, on the bases of local and territorial autonomy
